Another cop who - as usual - doesn't know the law

Post by Tdarcos » Tue Sep 17, 2019 7:39 am

Yahoo news reported the following:

Homeowner shoots and kills 3 masked men in possible 'stand your ground' case originally appeared on abcnews.go.com

A homeowner in Georgia shot and killed three young masked men at his home early Monday morning, according to Rockdale County Sheriff Eric Levett.

Authorities identified the three deceased individuals as juveniles Monday evening -- two 16-year-olds and one 15-year-old -- but have not released their names. The sheriff’s office told ABC News it waited to release information about the teens, all from Conyers, Georgia, until all three families were notified.

The homeowner, who has also not been identified by deputies, was taken to the station for questioning.

"It could be a 'stand your ground' type case, based on the preliminary [information] that we have learned so far," Levett said during the briefing.

Oh come on! Obviously, this is not a "Stand Your Ground" type case, this is a "castle doctrine" case. As a sheriff - usually the top law enforcement officer in the county - he should know this. A "stand your ground" law is used to coved situations where the law says you normally have a "duty to retreat." One never has a "duty to retreat" against uninvited visitors, trespassers, or in this case, "highwaymen" on your land or in your home. The right to protect oneself or one's property when on it is long established. This includes the right to eject such persons or to use force, up to and including deadly force, if reasonably necessary, to protect yourself or others.

No, but I'm not happy when something reported is obviously wrong.

Beyond that, if we extracted from the news all articles that have little to no effects on the vast majority of the populace, your typical newspaper might be two pages and the evening news would drop from 30 minutes to maybe 5.

Understood. Now I have questions. Commander, have you had the experience of having to talk to the cops in your life? We're looking for stories here if you wanna share 'em!

Reminds me of a great Norm Macdonald joke (the relevant part is at the start of the video but the rest of the 12 minutes is totally worth it).

[@Jonsey]I don't believe you that youtube embedding is working anymore. I looked up how to get the long url (either copy from the address bar or click share, embed, copy the url from the embed code) and no, it doesn't seem to work at all. Adding helps not at all. If you could perhaps embed a youtube video in a thread as an example of what to do then that would be awesome[/@Jonsey]

Don't you have to use instead of youtube?
